1) Pricing and product description

1.1. We take all reasonable care to ensure that the pricing and product description on our website and printed literature is correct at the time of publishing. We aim to keep our website and literature as up to date as possible. With this in mind prices and descriptions may change without warning. All dimensions quoted in the description of a product are approximate. We do not hold any responsibility if these dimensions are incorrect.

1.2 If we have incorrectly priced a product we are within our right to change this price without notice and cancel any orders that have been placed where the price has been incorrect. We are under no obligation to provide you with a product that has been incorrectly priced i.e. if the correct price is higher than illustrated.

1.3 Formal quotations and proposals for additional services are valid for a period of 30 days unless otherwise started. All quoted prices exclude VAT. VAT is at the standard rate. Delivery prices are included unless otherwise stated.

2) Purchasing

2.1 By purchasing from Lyme Bay Cabins through our website or acceptance of a formal quotation it is assumed that the customer agrees to all of the terms and conditions set out in this document.

2.2 The customer is responsible for giving the correct personal and site details for invoice and delivery at the point of purchase.

2.3 Goods are subject to availability. In the event the we are unable to supply the goods you have purchased and where we have received payment in full we will inform you as soon as possible and a full refund will be issued.

2.4 When accepting a personal quotation offer the customer is to give formal order acceptance in writing and sign the Lyme Bay Cabins Terms and Conditions. Order confirmation can be sent by post to Lyme Bay Cabins, Unit 8, Thorn Business Park, Salcombe Regis, Sidmouth, Devon, EX10 0JH or emailed to info@lymebaycabins.co.uk. Customers must ensure that they provide Lyme Bay Cabins with full and correct contact details and delivery address within their order acceptance.

3) Payment

3.1 When placing orders through Lyme Bay Cabins website payment is taken in full through Worldpay. This facility enables us to accept most types of debit and credit card through our online store.

3.2 Orders will only be placed with manufacturers once payment has been received in full.

3.3 When excepting a formal personalised proposal of a standard log cabin kit payment is back to back with the manufacturer’s terms. Log cabin orders will not be placed with the manufacturer until Lyme Bay Cabins receive cleared funds in full and also a signed and dated Terms and Conditions.

3.4 When ordering a bespoke log cabin kit, payment is back to back with the manufacturer’s terms which is 50% deposit to confirm the order and 50% when the cabin has been manufactured and is ready to be shipped to the UK. Orders will not be placed with the manufacturer until Lyme Bay Cabins receive cleared deposit funds and also a signed and dated Terms and Conditions.

3.5 If Lyme Bay Cabins are instructed to carry out additional minor services such as installation then payment is due once the works are completed and within 7 days of the customer receiving their invoice. Larger services might well require staged payment which will be agreed in writing before work commences.

3.6 It may be possible to pay a non refundable deposit to hold UK stock. The balance amount would then be due in full and the funds would need to show as cleared before the cabin is delivered to site.

3.7 Interest on overdue invoices shall accrue from the date that payment becomes due calculated on a daily basis until the date of payment at a rate of 8% per calendar month.

4) Risk and Title

4.1 Risk and title of the cabin, timber or garden product passes to the customer on full payment of the offer price. This applies to both internet purchases and or receiving formal order confirmation and payment through other forms.

5) Order cancellation

5.1 The customer is entitled to cancel their order of standard design log cabin, timber or garden product within 7 working days of Lyme Bay Cabins receiving payment of goods in full if a standard log cabin, timber or garden product has been ordered. However, a customer can not cancel their order if the log cabin,timber or garden product has been delivered to their site within 14 days of receiving cleared funds. Cancellation must be made by giving written notice and either posted recorded delivery to Lyme Bay Cabins, Unit 8, Thorn Business Park, Salcombe Regis, Sidmouth, Devon, EX10 0JH or emailed to info@lymebaycabins.co.uk. A refund of monies will be issued minus administration costs and other costs incurred totalling 20% of the payment made. If an order is cancelled after 7 working days of receiving payment in full then only 50% will be refunded.

5.2 If an order is cancelled for a bespoke log cabin after 7 working days of Lyme bay Cabins receiving a deposit payment then the deposit will be retained by Lyme Bay Cabins.

5.3 If the cabin has been received and signed for in good condition then we advise that the customer inspects the pallet and ticks off all of the items with the itemised parts list which will be inside the pallet. This should be carried out within 14 days of receiving the goods. If the customer decides to start to install the cabin before checking the consignment they will be deemed to have accepted the cabin. Also if the customer makes any alterations to the goods such as treating them they will also be deemed to have accepted the goods.

5.4 Any returned goods must be in their original packaging and on their original pallet. Any returned goods will be inspected and any repayment of funds will take place within a reasonable time after the items have been received. Refunds may be subject to fees to cover reasonable costs incurred by Lyme Bay Cabins such as return delivery costs along with the cost of items not returned in original condition.

6) Delivery

6.1 All deliveries are organised through the manufacturer and not Lyme Bay Cabins.

6.2 Delivery is strictly to UK mainland only. Delivery prices are typically included in our pricing but some areas such as the Highlands of Scotland may incur an additional delivery charge.

6.3 Deliveries will take place Monday-Friday between the hours of 6am and 7pm. The delivery date is an all-day appointment.

6.4 Log cabin deliveries will be made using a large flatbed lorry with a Hiab crane. Other timber and garden products will be delivered by a curtain sided lorry or smaller vehicle.

6.5 Lyme Bay Cabins will not be held liable for any delay or failure in delivery due to unforeseen circumstances (e.g. adverse weather, traffic, Force Major, strikes, war etc).

6.6 Log cabin deliveries will be made to the nearest point that is adjacent to the roadway and clear of obstructions. Carriers will not move products around or through a property. If the client requests for a log cabin to be delivered onto their property then Lyme Bay Cabins and the carrier will not be held responsible for any damage that may be caused.

6.7 The carrier will endeavour to make contact with the customer to confirm the expected delivery time on the day of delivery.

6.8 All deliveries must be signed for. It is advised that the customer is available to inspect and sign for the delivery. If the client decides to instruct a friend or agent then Lyme Bay Cabins must be informed prior to delivery. Lyme Bay Cabins can also offer a service to oversee the delivery (for those customer in the Lyme Bay Region). Please contact to discuss further.

6.9 Should the carrier be unable to complete a delivery due to no fault of their own, the manufacturer or Lyme Bay Cabins shall not be liable for the expense of the failed delivery. Any delays created for the carrier at the property (waiting time) could incur charges at a rate of £45 per hour (plus VAT). A re-delivery will incur an extra cost to be met by the customer. If the carrier is unable to complete delivery, for whatever reason other than delay caused by the customer, then no charge for re-scheduled delivery will be incurred by the customer.

6.10 Once the delivery has been accepted it is the customer’s responsibility to keep the goods covered and secure. Lyme Bay Cabins will not accept liability for stolen or damaged items.

6.11 If the customer feels that access to their site may be difficult then it is their responsibility to provide Lyme Bay Cabins with important access information prior to any purchase.

The customer will need to provide further details about the delivery site:
– Is the address on a made up (tarmac) road?
– Is the road wide enough for large lorries (e,g. dustbin lorry / fire engine)? – Can a lorry park within 6 metres (20ft) of the property?
– Are there cars parked on both sides of the street and if so, would this cause problems for lorry access?
– Is access likely to be restricted during any part of the day

Customers may also be asked to take photos of their site access and email them to Lyme Bay Cabins before an order is placed so that the logistics company can be made aware of any potential access issues.

7) Defects

7.1 Any defects to packaging and goods must be noted when the delivery is signed for. It is imperative that the delivery is checked against the delivery note/packing list within 14 days of delivery. If items have been damaged in transit then Lyme Bay Cabins will ask for photographs of the damage and where deemed appropriate arrange for replacement parts to be shipped as long as they have been informed within 14 days of the delivery. If informed after this time period then the customer is liable for the cost of replacement parts and the cost of shipping these replacements.

7.2 Should a defect occur within a reasonable period once the goods have been delivered the client must contact Lyme Bay Cabins in writing by post using recorded delivery or email, giving a detailed description and providing photographs of the defect. Photographs are imperative to help us determine its cause prior to rectification.

7.3 Where a defect is deemed to be the customers fault any rectification will be chargeable to the customer. Should a defect occur which is the fault of the manufacturer then Lyme Bay Cabins will work closely with the manufacturer and use their discretion as to replace, repair or refund.

7.4 If the customer decides to remedy any defects themselves or use a third party to remedy them, then Lyme Bay Cabins will not reimburse any money.

8) Installation of log cabin

8.1 Lyme Bay Cabins ensure that the appropriate level of Public Liability insurance is in place before any installation works commences. Bad weather and illness are considered outside of Lyme Bay Cabins control. Notice will be given to the customer as soon as possible if a delay is to occur.

8.2 Any alterations to that illustrated by the customer in their order acceptance must be given to Lyme Bay Cabins formally either by email or letter. Alterations will not proceed until the client has accepted additional costs if applicable.

8.3 All works carried out by Lyme Bay cabins will use all reasonable skill, care and suitable materials. On completion Lyme Bay Cabins will leave the site clean and tidy to a reasonable satisfaction of the customer.

8.4 Lyme Bay Cabins will not accept any responsibility for the build quality if the client decides to install the cabin themselves or instructs a third party to install it for them.

9) Privacy

9.1 The only information we will store about customers is name, address, phone number and email address.

9.2 Any credit and debit card details are securely managed by Worldpay.

9.2 We do not disclose customers information with any third parties.

10) Important

10.1 It is the customers responsibility to check that the proposed cabin or garden building and location of the cabin complies with the certain limits and conditions of permitted development. If the customer is unsure of this then further advice can be gained from local authorities. Lyme Bay Cabins will not be held responsible if a cabin or garden building is supplied/supplied and installed and does not comply to any required planning or building regulations requirements. If planning permission is required then it is the customers responsibility to make this application and obtain planning permission.

10.2 Installing a log cabin or garden building will require two or more adults who are competent at DIY. It is imperative that the customer and installers understand what is involved in the construction of a log cabin or garden building and the features of the timber they will be installing. Take time to read and study the install manuals and install diagrams that come with the products (inside the pallet wrapping).

10.3 Timber is a natural product and will change with it’s environment. The characteristics of timber means it will expand and contract through the seasons due to the levels or moisture in the atmosphere. It is therefore recommend that you do not to install your cabin in very wet conditions.

10.4 In the event that some of the timber has warped, gentle manipulation may be required during installation. Wetting or the application of weight may be necessary to help assembly.

10.5 During installation, you may be required to make minor adjustments. Once the building has been erected it will then settle under its own weight. It will also continue to move with the change in environment. This movement is completely natural. It is best practice to regularly check your building for movement and if necessary loosen and re-tighten screws around windows, doors etc.
